Workers compensation is run by each state, plus Comcare for Commonwealth employees. A lawyer can help when a claim is disputed, payments stop, or you may be entitled to a lump sum for permanent impairment or a common law claim.
Workers compensation replaces income and pays medical costs while you recover. Disputes about liability or capacity are common and can be challenged.
Each state has its own scheme, such as icare in NSW and WorkSafe in Victoria, with Comcare covering many Commonwealth employees. Access to lump sums and common law damages depends on the level of permanent impairment.
Understand the next step
Identify the employer, work location and any claim number or decision. A workplace injury can raise questions about the applicable scheme, treatment, work capacity and responses to insurer decisions.
Confirm whether related employment advice is included or requires a separate adviser.
Devonport, Burnie and Ulverstone are the listed centres for North West & West Coast. An office on the north coast may still be a considerable journey for a West Coast client.
For workers compensation, ask which parts of the work the firm handles itself and whether it has relevant TAS experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside North West & West Coast. Your home address alone does not determine the applicable process.
Provide a chronology, relevant locations and employer or insurer details, together with forms and decisions already received.
Discuss medical, employment, incident and expense records. Ask who will obtain reports and how access, privacy and expert costs will be managed.
Have any offer, assessment or release explained before agreeing. Clarify what a resolution would cover and whether related claims need separate advice.
Ask for the written meaning of no win, no fee, including expenses, any uplift and possible other costs. The phrase alone is not enough to compare arrangements.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Ask early about notice, claim and review limits in the relevant scheme. Keep the incident date and every insurer decision available for assessment.
Tasmania has a two-tier court system: the Magistrates Court and the Supreme Court, with no intermediate court. Guardianship, anti-discrimination and many review matters are heard by TASCAT. The Law Society of Tasmania issues practising certificates and the Legal Profession Board of Tasmania handles complaints.
