Every state runs its own CTP or motor accident scheme, with different rules about who can claim, time limits and what can be recovered. Lawyers lodge the claim, gather evidence and negotiate with the insurer or scheme.
Road injuries can mean months off work and long-term care. The scheme you claim under determines what you can recover and how quickly.
Every state runs compulsory third party insurance differently: NSW and Victoria have hybrid no-fault schemes, Queensland is fault-based, and WA and SA have their own models. Notice periods are short, often a few months from the accident.
Understand the next step
Give the accident location, date and details of the vehicles and insurers. Explain whether you are seeking help with an injury claim or property damage, because the work can be different.
Ask about the applicable state scheme and notices before assuming another person’s experience applies to your claim.
Devonport, Burnie and Ulverstone are the listed centres for North West & West Coast. An office on the north coast may still be a considerable journey for a West Coast client.
For motor vehicle accidents / ctp, ask which parts of the work the firm handles itself and whether it has relevant TAS experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside North West & West Coast. Your home address alone does not determine the applicable process.
Provide a chronology, relevant locations and employer or insurer details, together with forms and decisions already received.
Discuss medical, employment, incident and expense records. Ask who will obtain reports and how access, privacy and expert costs will be managed.
Have any offer, assessment or release explained before agreeing. Clarify what a resolution would cover and whether related claims need separate advice.
Ask for the written meaning of no win, no fee, including expenses, any uplift and possible other costs. The phrase alone is not enough to compare arrangements.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Ask early about notice, claim and review limits in the relevant scheme. Keep the incident date and every insurer decision available for assessment.
Tasmania has a two-tier court system: the Magistrates Court and the Supreme Court, with no intermediate court. Guardianship, anti-discrimination and many review matters are heard by TASCAT. The Law Society of Tasmania issues practising certificates and the Legal Profession Board of Tasmania handles complaints.
