My two American staffies got in a lot of trouble when they decided one morning to break out of the front fence of our rental property. They attacked a boarded collie kelpie cross that was walking past with his owner.
The whole ordeal was witnessed by about 15 unhelpful bystanders and neighbours. There was then a barrage of cowardly anonymous Facebook posts about the event, people’s social media opinion of what should happen, noting exact location of where we lived. The ironic part of this Facebook community page name was Make Murrumbeena Kind’. My family were demonized by an unforgiving community anonymously posting and failing to accumulate community uproar and momentum.
I felt so judged, ostracized by an accident, that we ended moving within 2 and half months. Our neighbours and community of Murrumbeena changed the way I look at people, how they misunderstand a dog’s behavior, their approach to pets and ultimately miseduacation about a type of breed. Whilst I appreciate my dogs were in the wrong in this event, they inevitably do not understand what has occurred. This incident showed me people’s predisposed judgement on these animals and their understanding of dog behavior towards each other, and how ‘everyone loves a dog until it doesn’t suit them’. My dogs are my family liability or asset, I learnt people judge anonymously as it’s the only way to express an opinion they have not directly impacting or related to them.
Shortly after moving, we paid a total 11k towards the owners vet costs, AirPods, clothes he claimed were damaged and dog accessories.
After 18 months, the council proceeded to press 12 charges against my partner and I and after 5 months of requests for brief of evidence, and 5 adjournments later we could start moving the legal process along. Toni helped with multiple phone calls prior to us even retaining them as our representatives. Toni and James in a short amount of time prepared, reviewed, and sought more information in our favor. It really is amazing the skills Toni and James have in order to thoroughly identify key facts and guide us through what is a convoluted process obligated by the council.
They sought a barrister who was very suitable for us (his last name was even Dogger) within a few days of being briefed in our case, he was familiar with minute details in our case, he was skillful in how he addressed our concerns, and negotiated with the councils’ prosecutor over a few days our 12 charges down to 4 and only one was liable legally for the event. We received a fine that may pay for a sign and poop bags for the year!
Whilst I wished this incident never occurred, I am so grateful to have a legal team who were personable and relatable. After what was a traumatic accident, Toni, James and Liam’s reassurance was really comforting throughout an overwhelming process.
