Residential tenancy laws differ by state and most disputes go to the state tribunal. Tenants' advice services are free in most states.
Tenancy disputes affect people's homes. Knowing your rights on bonds, repairs and termination makes a practical difference.
Each state has its own residential tenancies legislation, and several have limited no-grounds evictions in recent years. Disputes go to state tribunals, and bonds are held by state authorities.
Understand the next step
Say whether you are a renter, owner or another person affected, and provide any notice or application. Advice depends on the tenancy documents and the relevant state process.
Ask about immediate dates and representation; general property conveyancing is not the same as tenancy advice.
Warrnambool, Hamilton, Horsham and Portland represent different parts of the Western District and Wimmera. For farming, business or property work, describe the transaction and ownership rather than assuming a general regional practice offers every service.
For residential tenancy, ask which parts of the work the firm handles itself and whether it has relevant VIC experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside Western District & Wimmera. Your home address alone does not determine the applicable process.
Provide the address, parties and current contract or notice. Explain whether anything has been signed and identify every agreed date.
Ask which terms, searches and ownership questions will be reviewed. Explain finance, proposed use and any linked transaction.
Agree who communicates with agents, lenders and the other side. Confirm how documents are approved and what happens if the matter is delayed or disputed.
Separate legal fees from searches, registration, taxes and third-party expenses. Complex ownership, negotiations or a dispute may fall outside an advertised conveyancing price.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Seek review before signing where possible. Ask about the actual dates in your documents; cooling-off and completion arrangements differ across states and transactions.
In Victoria, the Magistrates' Court hears most criminal and minor civil matters, with the County Court and Supreme Court handling more serious cases.
