Retail, office and industrial leases carry long-term financial obligations. Lawyers negotiate terms such as rent reviews, outgoings, make-good and guarantees, and act in purchases and sales of commercial property.
Commercial leases and purchases lock in costs for years. Terms like outgoings, make-good and guarantees can decide whether a business survives.
Retail leases are protected by state retail leases legislation, which regulates disclosure, rent reviews and minimum terms. Stamp duty and GST treatment vary by transaction and state.
Understand the next step
Identify whether the work concerns a purchase, sale, new lease, renewal or dispute. Intended use, guarantees and ongoing obligations should be discussed alongside the headline rent or price.
Clarify whether planning, tax, building-condition and finance advice require additional professionals.
An Albany-based search can help Great Southern clients find a starting point for personal and business advice. For a rural property or estate, identify the assets, entities and people involved before requesting a quote.
For commercial property & leasing, ask which parts of the work the firm handles itself and whether it has relevant WA experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside Great Southern. Your home address alone does not determine the applicable process.
Provide the address, parties and current contract or notice. Explain whether anything has been signed and identify every agreed date.
Ask which terms, searches and ownership questions will be reviewed. Explain finance, proposed use and any linked transaction.
Agree who communicates with agents, lenders and the other side. Confirm how documents are approved and what happens if the matter is delayed or disputed.
Separate legal fees from searches, registration, taxes and third-party expenses. Complex ownership, negotiations or a dispute may fall outside an advertised conveyancing price.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Seek review before signing where possible. Ask about the actual dates in your documents; cooling-off and completion arrangements differ across states and transactions.
Western Australia is the only state with its own family court: the Family Court of Western Australia hears parenting and property matters for both married and de facto couples. Other matters start in the Magistrates Court, with the District and Supreme Courts for serious cases, and the State Administrative Tribunal for planning, guardianship and many licensing reviews. Lawyers are admitted and regulated by the Legal Practice Board.
