Homeowners use them for defective or incomplete work and builder insolvency. Builders and subcontractors use them for contracts and security of payment claims, which allow fast recovery of progress payments.
Building disputes involve large sums and technical questions. Acting early preserves insurance and warranty rights.
Each state has home building legislation, statutory warranties and home warranty insurance. Security of payment laws let contractors recover progress payments quickly through adjudication.
Understand the next step
Explain whether you need pre-contract review or help with defects, payment, delay or termination. Provide the full contract and variations so advice is based on the current agreement.
Ask about legal and expert costs separately and do not assume withholding payment or ending a contract is an appropriate first step.
Bunbury, Busselton and Margaret River are separate starting points in the South West. For land or business work, explain whether the issue concerns ownership, a proposed transaction, a lease or an existing dispute.
For building & construction, ask which parts of the work the firm handles itself and whether it has relevant WA experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside South West. Your home address alone does not determine the applicable process.
Provide the address, parties and current contract or notice. Explain whether anything has been signed and identify every agreed date.
Ask which terms, searches and ownership questions will be reviewed. Explain finance, proposed use and any linked transaction.
Agree who communicates with agents, lenders and the other side. Confirm how documents are approved and what happens if the matter is delayed or disputed.
Separate legal fees from searches, registration, taxes and third-party expenses. Complex ownership, negotiations or a dispute may fall outside an advertised conveyancing price.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Seek review before signing where possible. Ask about the actual dates in your documents; cooling-off and completion arrangements differ across states and transactions.
Western Australia is the only state with its own family court: the Family Court of Western Australia hears parenting and property matters for both married and de facto couples. Other matters start in the Magistrates Court, with the District and Supreme Courts for serious cases, and the State Administrative Tribunal for planning, guardianship and many licensing reviews. Lawyers are admitted and regulated by the Legal Practice Board.
Good to know
Notify the builder in writing, keep evidence, and check home warranty insurance and the state tribunal or building commission process.
Most matters start in the Magistrates Court. More serious cases go to the District Court or the Supreme Court of Western Australia. Family law matters are heard by the Family Court of Western Australia.
Practising certificates in Western Australia are managed by the Legal Practice Board of Western Australia. You can check a solicitor's status on its public register or by contacting it directly.
