Under the Australian Consumer Law, manufacturers can be liable for injuries caused by goods with safety defects. Claims range from individual cases to large class actions.
Dangerous products can cause serious injury, and manufacturers can be held responsible even without proof of negligence.
Part 3-5 of the Australian Consumer Law makes manufacturers liable for injury caused by goods with safety defects. The ACCC manages product safety and recalls.
Understand the next step
Identify the product, supplier, date of purchase and incident. Explain whether the issue is injury, property loss or a consumer remedy so the lawyer can identify the appropriate scope.
Ask how a consumer complaint differs from a claim for injury or consequential loss.
A city-centre address can be convenient for meetings, but it does not tell you which solicitor will handle the file. For a business transaction, employment issue or dispute, ask whether the team has experience with your particular industry and the size of the matter.
For product liability, ask which parts of the work the firm handles itself and whether it has relevant NSW experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside Sydney CBD. Your home address alone does not determine the applicable process.
Provide a chronology, relevant locations and employer or insurer details, together with forms and decisions already received.
Discuss medical, employment, incident and expense records. Ask who will obtain reports and how access, privacy and expert costs will be managed.
Have any offer, assessment or release explained before agreeing. Clarify what a resolution would cover and whether related claims need separate advice.
Ask for the written meaning of no win, no fee, including expenses, any uplift and possible other costs. The phrase alone is not enough to compare arrangements.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Ask early about notice, claim and review limits in the relevant scheme. Keep the incident date and every insurer decision available for assessment.
