These claims need expert medical evidence about the standard of care and whether it caused the injury. Lawyers obtain records, brief experts and negotiate with insurers for doctors and hospitals.
When treatment goes wrong, a claim can fund the extra care and support needed. These claims are complex and depend heavily on expert evidence.
Medical negligence claims run under state civil liability laws, with a modified standard of care that considers widely accepted peer professional opinion. Health complaints commissioners and AHPRA deal with complaints separately from compensation.
Understand the next step
Describe the treatment, the concern and the effect on you in chronological order. The lawyer should explain whether independent medical assessment is needed and how that differs from making a service complaint.
An unsatisfactory outcome does not by itself establish negligence; ask for an assessment based on records and appropriate expertise.
Bunbury, Busselton and Margaret River are separate starting points in the South West. For land or business work, explain whether the issue concerns ownership, a proposed transaction, a lease or an existing dispute.
For medical negligence, ask which parts of the work the firm handles itself and whether it has relevant WA experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside South West. Your home address alone does not determine the applicable process.
Provide a chronology, relevant locations and employer or insurer details, together with forms and decisions already received.
Discuss medical, employment, incident and expense records. Ask who will obtain reports and how access, privacy and expert costs will be managed.
Have any offer, assessment or release explained before agreeing. Clarify what a resolution would cover and whether related claims need separate advice.
Ask for the written meaning of no win, no fee, including expenses, any uplift and possible other costs. The phrase alone is not enough to compare arrangements.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Ask early about notice, claim and review limits in the relevant scheme. Keep the incident date and every insurer decision available for assessment.
Western Australia is the only state with its own family court: the Family Court of Western Australia hears parenting and property matters for both married and de facto couples. Other matters start in the Magistrates Court, with the District and Supreme Courts for serious cases, and the State Administrative Tribunal for planning, guardianship and many licensing reviews. Lawyers are admitted and regulated by the Legal Practice Board.
