Class actions have covered product defects, investor losses, consumer overcharging and more. Group members usually don't pay upfront, and funding may come from a litigation funder or contingency arrangement where permitted.
Class actions let thousands of people with the same problem pursue a claim together, which no individual could afford alone.
Australia's federal class action regime began in 1992, with Victoria, NSW, Queensland, WA and Tasmania adding their own. Victoria allows group costs orders, a form of contingency fee, in its Supreme Court.
Understand the next step
Identify the proposed or existing proceeding and any registration or settlement notice. Ask what participation involves, who represents the group and how funding and deductions are explained.
Do not assume registering interest and becoming bound by a proceeding or settlement are the same event.
Bunbury, Busselton and Margaret River are separate starting points in the South West. For land or business work, explain whether the issue concerns ownership, a proposed transaction, a lease or an existing dispute.
For class actions, ask which parts of the work the firm handles itself and whether it has relevant WA experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside South West. Your home address alone does not determine the applicable process.
Provide a chronology, relevant locations and employer or insurer details, together with forms and decisions already received.
Discuss medical, employment, incident and expense records. Ask who will obtain reports and how access, privacy and expert costs will be managed.
Have any offer, assessment or release explained before agreeing. Clarify what a resolution would cover and whether related claims need separate advice.
Ask for the written meaning of no win, no fee, including expenses, any uplift and possible other costs. The phrase alone is not enough to compare arrangements.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Ask early about notice, claim and review limits in the relevant scheme. Keep the incident date and every insurer decision available for assessment.
Western Australia is the only state with its own family court: the Family Court of Western Australia hears parenting and property matters for both married and de facto couples. Other matters start in the Magistrates Court, with the District and Supreme Courts for serious cases, and the State Administrative Tribunal for planning, guardianship and many licensing reviews. Lawyers are admitted and regulated by the Legal Practice Board.
