The court looks at the asset pool, each party's financial and non-financial contributions, future needs such as care of children and earning capacity, and whether the result is just and equitable. Superannuation can be split. Agreements can be made binding through consent orders or a financial agreement.
A property settlement determines who keeps the home, how super is divided and who carries debts. It is often the biggest financial decision of a person's life.
Courts follow a structured approach under the Family Law Act: identify the asset pool, assess contributions, consider future needs, and check the result is just and equitable. Superannuation can be split. Married couples have 12 months after divorce, and de facto couples two years after separation, to apply.
Understand the next step
A useful assessment starts with the full financial picture, not only the family home. Explain ownership, liabilities and any business or trust interests so the lawyer can identify the information still needed.
Ask whether transfers, refinancing and tax advice are included or need separate professionals and budgets.
Darwin, Palmerston and Casuarina are grouped for this directory search. For a workplace, tenancy or government-decision matter, identify the decision-maker or other party and gather the written notice before contacting a firm.
For family property settlement, ask which parts of the work the firm handles itself and whether it has relevant NT experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside Darwin & Palmerston. Your home address alone does not determine the applicable process.
Explain the relationship history, current arrangements and outcome you want. Identify immediate concerns and provide every existing order or agreement.
Discuss negotiation and family dispute resolution. Parenting applications generally involve prior dispute resolution unless an exception applies; ask the lawyer to assess the appropriate process.
Ask how an agreement would be documented and implemented. Clarify who handles related transfers, finance and estate-planning work.
Ask for separate estimates for advice, negotiation, document preparation and court work. A fixed divorce-application fee does not necessarily cover parenting or financial disputes.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Highlight court dates, proposed travel or relocation and any planned property sale. Ask which time limits apply to your particular issues rather than assuming there is one deadline for everything.
In the Northern Territory, the Local Court hears most matters, including many criminal cases, with the Supreme Court above it. NTCAT handles tenancy, guardianship and many administrative disputes.
