Fraud and corporate crime cases often involve large volumes of financial records and regulators such as ASIC or the ATO alongside police. Lawyers manage investigations, compulsory examinations, and defended hearings.
Fraud and corporate charges often involve regulators and police together, and early missteps in interviews can be costly.
Regulators such as ASIC, the ATO and the ACCC have compulsory investigation powers. Serious Commonwealth matters are prosecuted by the Commonwealth Director of Public Prosecutions.
Understand the next step
Identify the investigating body, alleged transactions and whether you are enquiring personally or for a business. Records and conflicts between individuals and entities need careful handling.
Ask about preserving records and coordinating any regulatory, employment or civil issues with the criminal advice.
Midland and Cannington are the centres listed for Perth East. For a property, business or family matter, identify whether you need a single document reviewed or ongoing representation.
For fraud & white collar crime, ask which parts of the work the firm handles itself and whether it has relevant WA experience. Let the lawyer know if a property, employer, other party or existing proceeding is outside Perth East. Your home address alone does not determine the applicable process.
Send the charge, summons, bail paperwork and hearing dates through the method requested by the lawyer. Identify whether you are enquiring for yourself or someone else.
Ask what evidence is available and what must be obtained. Decisions about a plea or statement should follow advice on your own circumstances.
Confirm who will attend the next event, where to meet and what preparation is included. Ask how changes in the case would affect the estimate.
One mention, a contested hearing and an appeal are different scopes of work. Ask about preparation, barrister fees and additional appearances.
Ask for a written scope identifying the work you are authorising, the person responsible and when costs will be reviewed. If you only want advice on one step, say so before the firm begins wider work.
Make hearing dates and bail conditions clear at first contact. If the firm cannot assist in time, ask about an available practitioner or the relevant legal-aid service.
Western Australia is the only state with its own family court: the Family Court of Western Australia hears parenting and property matters for both married and de facto couples. Other matters start in the Magistrates Court, with the District and Supreme Courts for serious cases, and the State Administrative Tribunal for planning, guardianship and many licensing reviews. Lawyers are admitted and regulated by the Legal Practice Board.
